Intressant med ny uppdatering! Ser ut att väldigt få fall har avgjorts och lagts ner under den regeln och essensen av regeln som Gambia åberopar verkar vara :
”Consequently, the tribunal should uphold the respondent’s Rule 41(5) objection only if the claim is obviously without legal merit and only if it this is manifestly the case.”
Obviously Without legal merit - känns som att Pace o co. Har för bra koll på kontrakten osv för att åka dit på en sådan ”enkel” grej??
Vidare kom den uppdateringen 1 dag innan fristen gått ut! Misstänker att Gambia försöker köpa sig tid!!?
Är det inte extremt otroligt att fallet skulle läggas ner med "obviously without legal merit" med tanke på APCLs erfarenheter OCH INTE MINST!! vad den högt ansedde och erfarna minster of Justive Abubacarr Marie Tambadou sa och som rapporterades 20/4: "pushing for an amicable settlement with African Petroleum"

(5) Unless the parties have agreed to another expedited procedure for making preliminary objections, a party may, no later than 30 days after the constitution of the Tribunal, and in any event before the first session of the Tribunal, file an objection that a claim is manifestly without legal merit. The party shall specify as precisely as possible the basis for the objection. The Tribunal, after giving the parties the opportunity to present their observations on the objection, shall, at its first session or promptly thereafter, notify the parties of its decision on the objection. The decision of the Tribunal shall be without prejudice to the right of a party to file an objection pursuant to paragraph (1) or to object, in the course of the proceeding, that a claim lacks legal merit.
III. Procedure
The respondent may file an objection under Rule 41(5) within 30 days of the constitution of the tribunal. The tribunal should give each party a proper opportunity to be heard. In principle, a tribunal can take a decision simply on the written submissions of the parties, but in most instances there are two rounds of written arguments, followed by an oral phase to be held in conjunction with the first session.
If the tribunal decides that all claims are manifestly without legal merit, it will render an award, while in case it rejects some or all of the objections – the tribunal issues a decision. In such a decision, the tribunal disposes of the questions very briefly in order not to prejudge the merits.
There are a few consequences of the differentiation between a decision and an award. As it is well known, an award disposes finally of all questions, while a decision may be compared to a “partial award.” The difference between the two acts relates to their enforceability and the possibility for annulment. Thus, a decision is not subject to annulment or enforcement until the case is finally disposed of.

C. Rule 41(5) in the Context of the ICSID Convention
It is remarkable how well integrated Rule 41(5) is with the rest of the ICSID arbitration system, in particular the ICSID Convention. Indeed, Rule 41(5) forms a harmonious continuum with Article 36(3) of the Convention. That Article provides that “[t]he Secretary-General shall register the request unless he
finds, on the basis of the information contained in the request, that the dispute is manifestly outside the jurisdiction of the Centre. He shall forthwith notify the parties of registration or refusal to register.”

Ser vi officiell lösning och PM angåendei både Gambia och Senegal inom kort?! med alla artiklar och publiceringar som gjorts senaste månaden och i synnerhet sista veckan tror jag det alla dagar i veckan! Sierra Leone ska vi inte heller glömma bort som kanske ligger närmast för operativ verksamhet och med utökad Licens och affärsmässig potential!

Har alla fått med sig att det alltså är Gambias Ministry of Petroleum som är orsaken till den här ICSID-processen?
Här är deras hemsida och om deras sak i ICSID är i samma klass som hemsidan tror jag nog detta blir en enkel och fördelaktig utgång för oss. :D

After several weeks of behind-the-scenes talks, on June 7 the Gambian government formally resumed negotiations with the British oil junior African Petroleum (AP) and obtained the temporary freeze of an arbitration procedure at the International Court for Settlement of Investor Disputes (ICSID). AP, which was founded by Australian magnate Frank Timis, filed a suit to the ICSID in October 2017 over the Gambian government's withdrawal of contracts to operate blocks A1 and A4 when President Adam Barrow came to power. To avoid a costly court case that could land the government with heavy fines to pay, the Gambian justice minister Abubacarr Marie Tambadou has been trying to reach an out-of-court settlement since the beginning of the year. The dispute has also been an obstacle to selling the two blocks to another oil company, since no major would want to invest while a legal case is ongoing.
